2.INFORMATION IN COMPLIANCE WITH THE PROVISIONS OF THE ORGANIC LAW ON THE PROTECTION OF PERSONAL DATA: 
2.1 Start of information:

Tharchives hereby informs you regarding its Privacy Policy in compliance with the provisions of article 5 of the law 15 from December 13, 99. The Protection of Private Information (Personal Information/PPI). We are informing you explicitly, and undoubtedly that the data that you provided through using forms (also including the contact and hand in forms) for these purposes on Tharchives, during your use of the Service of Tharchives these files will be processed in under the responsibility of THARCHIVES,  that is duly notified in the General Registry of the Spanish Agency for Data Protection (GRSADP), with the purpose of keeping and fulfilling the relationship of the client of the service with Tharchives and provision of services derived from it.

Likewise, in compliance with the provisions of the above-mentioned PPI and Law 34 fro July 11, 02, on the Electronic Commerce and Information Society Services Act (ECISSA), we advise you that your data may be used for the purpose of sending you commercial and civil communications related to our entity via email, or a corresponding electronic method of communication.

In the same way, we inform you that your data will be transferred in all those cases in which it is necessary for the development, achievement and control of the connection of the recipient of the service with Tharchives or in those cases in which it is authorized by a regulation with the power of law, and in particular, when one of the following cases takes place: a) The purpose of the processing or assignment is to satisfy a legitimate interest of the data controller or assignee covered by the stated policy; b) The treatment or transfer of the data is required for the data controller to accomplish a duty imposed by the stated regulation.

     In this regard, Tharchives guarantees compliance with  the current regulations on the protection of personal data, reflected in Organic Law 3/18, of December 5, on the Protection of Personal Data and Guarantee of Digital Rights (PPD GDR) . It also complies with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 16 on the protection of natural persons (GDPR).

2.2 Purpose:

The Purpose of THARCHIVES we treat the information (data) provided by the interested people in order to:

-Being able to keep the relation with the client for the billing and collection.

-Manage the sending of the requested data.

-Provide the interested parties with offers of products and services, as well as, any updates by the newsletter. The rejection of this service implies that we will not be able to keep you updated about our news.

-Bag Spa Services:

For our specialized bag cleaning and restoration services we collect:

  • Phone numbers for consultation scheduling and service coordination
  • Photographs of items submitted for assessment and documentation purposes
  • Additional service requirements and preferences

This data is used solely for service provision and consultation purposes.

-Payment Processing:

We process payments through secure third-party providers including Stripe, Google Pay, and Apple Pay. We do not store payment card details on our servers. Payment information is processed using industry-standard tokenization and encryption. Transaction data is retained only as required for accounting, customer service, and legal compliance purposes.

-Fraud Prevention and Security:

To protect our business and customers, we may use third-party services (including MaxMind) for fraud detection, geographic verification, and security purposes. This may involve processing IP addresses and transaction patterns. No personal identification data is shared beyond what is necessary for security verification.

2.3 Principle of consent:

The consent of processing your data for the purposes that were described in the previous section will be understood as provided by checking the corresponding box that was provided for this purpose on our website (Tharchives).

2.4 The mandatory nature of the requested data: 

The accomplishment of each and every one of the boxes that appear in the forms that were provided for this purpose on our website are mandatory (The mandatory fields will be marked with an asterisk). The refusal to accept these terms and provide your data would mean that the relationship of the recipient of the service and tharchives would be impossible to maintain, since these are necessary for the provision of the services derived from it.

2.5 Authenticity of the provided data:

The recipient of the service will be solely responsible for the accuracy and authenticity of the data provided, THARCHIVES are acting in good faith as a mere service provider. In the event that the recipient of the service provides inaccurate/false information from third parties without their consent to do so, they will respond personally to THARCHIVES, those affected parties, the Spanish Agency for Data Protection (SADP) and, in the appropriate cases, regional authorities of data protection, and the responsibilities derived from those situations.

THARCHIVES does not collect data from individuals under fourteen years of age through the website. In the event that a person under the age of fourteen provides their data through the forms that are provided for this purpose on our website or in any other data collection channel, they will be immediately received and deleted simultaneously you must be aware of such circumstance. In order to comply with the provisions of article 4.3 of the PPI, the client of the service undertakes to notify THARCHIVES of changes to their data (for example your address for an order), so they are required to respond truthfully to Tharchives in this case.

2.6 Data security policy:

THARCHIVES undertakes the policy to comply with its obligation of concealment regarding personal data and its duty to keep it and will use all necessary technical and organizational measures to guarantee the security of personal data and prevent its alteration, loss, or unauthorized access, taking into account the state of the technology, the nature of the data stored and the risks to which they are exposed, whether they come from human action or from the physical or the natural environment, developed in Title VIII of the Royal Decree 1720/07, of December 21, which approves the Regulations for the development of Organic Law 15/99, of December 13, on the Protection of Personal Data.

2.7 Exertion of rights:

In compliance with the provisions of the PPI and Royal Decree 1720/07, of December 21, which approves the Regulations for its development, the client of the service can exercise, at any time, their rights of access, rectification, cancellation and opposition to the person responsible for the file or treatment. The exercise of rights must be made in writing, attaching a photocopy of your identification document, and directing it to the email address info@tharchives.com.

2.8 Responsible for data:

The responsible for the treatment of data is THARCHIVES, with an address for contact or notification purposes at Calle Dr. Gonzalez 2,  03730 Jávea (Xabia), Spain.

2.9 Conservation of data:

The data for the management of the relationship with the client and the invoicing and collection of the services will be kept during the entire time that the agreement is in place. Once said relationship is terminated, where appropriate, the data may be kept for the time required by applicable law and until the possible responsibilities derived from the agreement prescribe.

The data for sending commercial communications of our services or products will be kept indefinitely until you request to delete these when appropriate. We will not keep your personal data for any purpose for longer than is necessary and will only retain the personal data that is necessary in connection with that purpose. In addition, we must retain certain information in agreement with the law or for as long as is reasonably required to comply with regulatory requirements, resolve disputes, prevent fraud and abuse, or in order to, enforce our terms and conditions.

Bag Spa service records (including consultation images and communication) are retained for 2 years after service completion for warranty and reference purposes, unless you request earlier deletion.

2.10 Recipients:

No data will be transferred to third parties, except where there is a legal obligation. International data transfers are not made.

2.11 Commercial profile:

We will not create a commercial profile based on the information that you have provided.

No automatic decisions will be made based on this profile.

2.12 Rights:

Anyone has the right to obtain confirmation as to whether THARCHIVES is processing personal information that concerns you the client, and the following information: the purposes of the processing; the categories of data processed; the recipients or categories of recipients to whom they have been communicated or will be communicated; if possible, the expected period of conservation of the personal data or, if not possible, the criteria used to determine this period.

Those that are interested have the right to access their personal data, as well as to request the rectification of any unauthentic/inaccurate data or, in an appropriate situation may request its deletion when, among other reasons, the data is no longer necessary for the purposes for which it was collected.  The deletion of this data may be requested by those interested if one of the following circumstances arises:  

-That the data is not necessarily in relation to the purposes for which they were collected or treated.

-That consent is withdrawn and the processing is not based on any other legal basis.

-That you oppose the treatment and other legitimate reasons for the treatment do not prevail.

-That have been processed illegally.

2.13 Cookies Information:

The legal basis for the processing of personal data in this context are Art. 6 (1) lit. c GDPR and Art. 6 (1) lit. f GDPR. Our legitimate interest is the management of the cookies and similar technologies used and the related consents.

The provision of personal data is neither contractually required nor necessary for the conclusion of a contract. You are not obliged to provide the personal data. If you do not provide the personal data, we will not be able to manage your consents. Please note: That if you accept the use of cookies your IP address will be stored along with the consent to the use of cookies for the legal time frame.
