• Product(s): These are the items that are offered by Tharchives for sale on the web shop
• Agreement: The agreement for the purchase/order of a product by a customer on our web shop
• Service: The legal agreement(s) between Tharchives and the customer who wishes to use the Tharchives service.

1.2. The terms and conditions listed here apply to every use of the web shop, every item in Tharchives, and every purchase of product(s) on the web shop and all the agreement(s) that were concluded and are to be concluded between Tharchives and its customer with their associated obligations.

2. Use of the web shop (Tharchives)

2.1. Tharchives may only be used by Customers.

2.2. Secondly, By using Tharchives, the customer is agreeing to the following:

• Only to use the Tharchives shop for legitimate purposes or Orders/Purchase(s):
• Not to use the Tharchives shop in the concluded of trading, commercial and their competent activities
• To keep his/her (login/order) data of the Tharchives confidential and not to provide these data to any third parties:
• To not place fraudulent orders.
• to provide Tharchives with the correct information accurately and precisely.
• Acknowledge that these terms and conditions apply.

3. Accounts:

3.1. When you create an account with Tharchives, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms of Service. Thus this may result in immediate termination of your account on our Service.

3.2. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

3.3. Third, you agree not to disclose your password to any third party. Furthermore, you must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Products Information & Availability:

4.1. All items are unique, pre-owned pieces with limited availability.

4.2. Items are reserved upon payment confirmation.

4.3. We reserve the right to cancel orders if items become unavailable due to damage or other unforeseen circumstances.

4.4. Product descriptions include condition notes and measurements.

4.5. Authenticity is guaranteed for all designer items.

4.6. Items are sold “as described” reflecting their pre-owned condition.

5. Pricing:

5.1. The price of the products is the price that is specified in the shop, unless an evident error is involved.

5.2. In the event of evident mistakes in prices, Tharchives will inform the customer who made an order of this as quickly as possible. The customer will then be given the possibility to confirm the order at the corrected price or to cancel the order. In the case that tharchives can’t contact the customer or fails to do so, the amount paid by the customer will be refunded.

5.3. The product prices includes any applicable VAT, but does not include the shipping costs. These costs will be added to the total amount, and will be specified clearly durning the checkout process.

5.4. Fourth, our Prices can be changed at any given time, Except for in the case of 5.2., this however will not affect the orders that Tharchives has already confirmed.

6. Returns & Refunds Policy:

6.1. Return Period: You have 14 days from the date of delivery to return items for a full refund

6.2. Return Period: Items must be returned in their original condition:

• Unworn and unwashed
• With all original tags attached
• In original packaging where provided
• Free from additional damage, stains, or odors.

6.3. Return Process:

• Contact info@tharchives.com before returning
• Customer is responsible for return shipping costs
• Returns must be sent with tracking confirmation
• Refunds processed within 5-7 working days after reception.

6.4. Non-Returnable Items:

The following cannot be returned for hygiene reasons:

• Items worn for more than trying on
• Items with removed tags
• Items damaged by customer

7. Pre-owned Goods Disclaimer:

7.1. Nature of Goods

All items sold are pre-owned luxury designer pieces. By purchasing, you acknowledge:

• Items may show normal signs of previous wear.
• Minor imperfections consistent with secondhand goods are expected.
• Each item’s condition is accurately described in the product listing
• Items are sold “as described” in their current condition

7.2. Condition Standards:

• NEW WITH TAGS: As stated the item is with the original tags, brand new, never worn (with exception of the model photo’s)
• NEW WITHOUT TAGS: The item is new, however the original tags have been removed.
• PERFECT: The item is previously worn, but in pristine condition with no visible wear, stains, or damage.
• GOOD: Light to moderate wear that may include:

1. Minor fabric pilling
2. Slight Fading
3. Small, barely noticeable marks
4. Normal creasing from wear

• SATISFACTORY: Noticeable wear including:

1. Visible signs of use.
2. Minor stains or marks (clearly described)
3. Some fabric wear or stretching
4. All imperfections photographed and detailed in description.

7.3. Authentication Guarantee: 

We guarantee the authenticity of all designer items. However, as pre-owned goods, we cannot provide warranties on manufacturing defects or original construction issues.

8. Consumer Rights (Secondhand Goods):

8.1. Legal Guarantee

Under Spanish/EU consumer law, a 2-year legal guarantee applies to secondhand goods. However, expectations are adjusted for pre-owned items:

• Defects must be beyond normal wear for secondhand goods
• Quality expectation reflect the pre-owned nature
• Age-related wear is not considered a defect.

8.2. Dispute Resolution

In case of disputes regarding item condition:

• Contact us within 48 hours of delivery
• Provide photographic evidence
• We reserve the right to request independent assessment
• Mediation preferred before legal action

8.3. Jurisdiction

These terms are governed by Spanish law, and any disputes will be subject to the jurisdiction of Spanish courts.

9.1. Bag Spa Services:

• Cleaning and restoration services available for luxury bags
• Consultation and assessment required before service
• Custom pricing provided after evaluation

• Separate terms and conditions apply for restoration services
• Turnaround time varies depending on treatment required

10. Product Descriptions & Photography:

10.1. Accuracy Standards

We strive for accurate product descriptions and photography. However:

• Colors may vary due to screen settings and lighting conditions
• Measurements are approximate with +/- 2cm tolerance
• All visible flaws and imperfections are disclosed in descriptions.
• Additional photos available upon request before purchase

10.2. Vintage Sizing

Vintage and older designer pieces may have different sizing standards than contemporary items. Always refer to provided measurements rather than size labels alone (when available).

10.3. Photography Rights

• All product images remain property of Tharchives
• Images may not be used without written permission
• Customer styling photos may be reposted with credit and permission
• Customers can request removal of their images at any time

11. Force Majeure:

11.1. Circumstances Beyond Control

We are not liable for delays, cancellations, or failures in performance due to circumstances beyond our reasonable control, including but not limited to:

• Natural disasters, extreme weather conditions
• Strikes, labor disputes, or transportation disruptions
• Government actions, regulations, or restrictions
• Postal service or courier disruptions
• Technical failures or cyber attacks.
• Pandemic-related restrictions or health emergencies

11.2. Notification and Resolution:

• We will notify customers promptly of any delays
• Updated delivery estimates will be provided when available
• Refunds available if delays exceed 30 days
• Force majeure events do not affect your statutory consumer rights

12. Establishment of the Agreement (between the Customer and Tharchives):

12.1. This is when an order is placed by the customer completing the ordering process in the web shop.

12.2. Subject to what is agreed upon in section 4, an Agreement is established upon the moment when Tharchives has electronically confirmed the receipt of the order and the customer has met the conditions stipulated with the order.

12.3. In the event that Tharchives has valid reasons for not entering into the agreement, Tharchives is entitled to refuse an order or to stipulate special conditions for fulfilment.

13. Delivery:

13.1. Subject to what is agreed upon in section 12, Tharchives will offer the accepted orders to the postal service as soon as possible, but no later than within 4 days after receipt of the payment, unless a different delivery term has been agreed upon, or in case of a national holiday preventing the postage of the item earlier. In the event that the delivery is delayed or the order can’t be fulfilled, the customer will be notified of this no later than 4 days after he/she has placed the order. In that case, the customer is titled to dissolve the agreement at no cost.

13.2. Additionally, following the dissolution in agreement with the previous paragraph 13.1., Tharchives will repay the amount that the customer paid within 24-48 hours.

14. Payments:

14.1. The customer makes the payment in agreement with the payment methods provided in the ordering process and in agreement with the conditions agreed upon.

14.2. Furthermore, the customer must immediately notify Tharchives of any inaccuracies in the payment information that was provided by him/her.

14.3. In the event that the customer fails to pay, the order will be cancelled automatically.

15. Retention of title:

15.1. The title to products only passes to the customer after the purchase amount has been paid in full.

16. Intellectual Property:

16.1. The Service and its original content, features and functionality are and will remain the exclusive property of Tharchives and its licensors.

17. Links To Other Web Sites:

17.1. Our Service may contain links to third-party web sites or services that are not owned or controlled by Tharchives.

17.2. Moreover Tharchives has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Tharchives shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

17.3. In addition, we strongly advise you to read the terms and conditions of any third-party websites. As well as the privacy policies of the services that you visit.

18. Termination:

18.1. We may also terminate or suspend your account immediately without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

18.2. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

18.3. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

19. Disclaimer:

19.1. Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

20. Governing Law:

20.1. These Terms shall be governed and construed in accordance with the laws of Spain without regard to its conflict of law provisions.

20.2. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

21. Changes:

21.1. Accordingly, we reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is made we will try to provide a notice beforehand. Henceforth this will be provided 30 days before the terms take effect only to those who are subscribed to our newsletter. What constitutes a material change will be determined at our sole discretion.

21.2. By continuing to access or use our services after those revisions become effective. You agree to be bound by the revised terms. However, if you do not agree to the new terms, please stop using the Service.
